

A Slimy Way To Beat Zoning Density In Oro Valley

Michael has sent us two items. The second: "“Our Town leaders have clearly lost there common sense and are not paying attention to the details. They are way over their heads and have got their greedy little hands to far into my pocket. It is time for new leadership.” We Agree!
And it is no wonder Mike feels this way. Read on:
"I was involved in a law suit trying to stop Oro Valley from granting a lot split to a local investor. This person purchased a 5.5 acre lot on Linda Vista Blvd, directly north and adjacent to the CDO Baseball fields and ... proceeded to purchase 1 plus acres of land from CDO High School which currently is a ball field. This land was attached to his giving him enough land for 2 homes. The slimy part is a deed was recorded giving full use of the land forever to the High School. Sounds like a nice way for the HS to make $25,000 bucks and really lose nothing.
The problem is Oro Valley sees nothing wrong with this approach: A high school and a residence sharing the same piece of property. As soon as other people learn this trick they can purchase a parking lot or baseball field or drainage area or whatever, include it with their parcel to build more and simply place a deed on the new parcel giving its use back to the original owner. No state law against it. I spent many thousands fighting this and the Phoenix Law Firm the Town hired fought me every step of the way. The Town using “our money” had nothing to lose. I finally tired of the bleeding and took a written promise from the Town that this would not happen again at CDO High School, and was reimbursed for my attorney’s fees. They are free to do this again anywhere else it works. Watch out. "
